Called the attorney's office for the plaintiff in the foreclosure suit again today. One of his paras told me that all I needed to do was call the county clerk and file a disclaimer saying I have no rights, claim or title to the property.

So I called the county clerk. Who told me that they don't have paperwork like that. They'll gladly file it for me, but an attorney has to actually provide it. And they gave me the number for legal aid of OK.

I called the plaintiff's attorneys back and left a message mentioning that the information they gave me was incorrect and that the county clerk said I needed paperwork from them. Still have not gotten a call back.

Called Legal Aid of OK. Was told that since I am above the poverty line they can not help me, but that it's a simple matter of filling out a form (that no one seems to know where to find). Oh, and since the default judgement has already been handed down My Credit Rating Has Probably Been Affected. He told me to call the JAG.

So I called the JAG who told me that I can't make an appointment but I'm more than welcome to wait until Tuesday, show up at 08:30 and sit around all day as a walk-in and hope they have time to sneak me in (except for when they close for lunch, then I have to leave). If not then I can wait until the Tuesday after and try it again.

Legal Aid of OK man did tell me I was making him uncomfortable. Because I was upset about my hard fought credit rating going down the crapper and the fact that I'm currently liable for a debt I was never part of until I fill out this mysterious form no one can give me and therefore began to sniffle on the phone.

I'm sorry my trauma is bothering you, asshat. Fucking deal with it. I wasn't yelling, cursing, or blaming you. I wasn't bawling. I was sniffling and fighting back very quiet tears which made it hard to speak, you giant wad of suck. That is actually fairly restrained for me and I think after my third run-around of the day I have a right to be a little upset!

I am... displeased.

try stepping down in the chain and calling the people on post that help you find a place to live. they may have had experience with this before or could just get the paperwork for you without the big runaround. If not, try whatever contact you were given to call if you had problems while hubby was away, you know the one you never call...

It might be on there, but I can't tell. All I keep hearing is that it's a disclaimer or something. No one has given me a form number or an actual name or anything. It's very frustrating and when I get frustrated I start to get upset and this is... gah.

I'm not sure, but I think they're the same people. The last time I contacted anyone on base it was through legal services and I understand they're probably really busy (hence the no appointment) which is why I'm not pitching a fit (for once).

I'm guessing because it's my name and not me and the hubby they got it from when I had to sign the form saying I accepted the notice that I needed to be out of the house in thirty days. And I told the sheriff's rep. at the time that I was a tenenat through the local realtor. So I really don't know how I went from acknowledging that the house was about to be foreclosed upon and I needed to move out to a Defendant. There's a jump in logic there that I'm just not making.

Oh and Legal Aid of OK guy also said that I should have started doing something about this before the judgement. I reminded him that that would have been difficult since I didn't know I was involved in the suit until Yesterday.

Go to the legal assistance office on Tuesday. Take all of the paperwork you have. You'll have to sigh in and wait, if you go in early you may not have to wait long. Tell them everything that's happened. Let them know that I'm deployed and as signee on the lease and tenant I should have been named in the judgement, and since judicial action criminal or civil cannot be taken against me while I'm over here. The previous judgment should be overturned.

And if that's not grounds enough inadequate effort was taken to contact you, as the current landlord and the previous one are the same and they know where we live.

I'm real tired of these people jacking us around, and I know you are too.

Would the county clerk and the courthouse clerk be two different people? *she asks hopefully* Because the county clerk is the one I think I called and she said they didn't have it, but if someone else around here might...

Captain has asked me to talk to the Legal Services/JAG because of our credit rating issues so I'll see what they say on Tuesday if I can get in. It looks like no one will be coming to collect money until after the property is sold so I think I have a few weeks to talk to the legal aids on base, it would be nice to have professionals standing behind me when I do whatever has to be done.

The courthouse should be different than county. (though I am Canadian). Theoretically, the courthouse should have all forms required.
